Applicability Statement

This Privacy Policy applies to all users, including residents of the European Union and the European Economic Area (EEA). For EU/EEA residents, this policy and our data processing practices comply with the General Data Protection Regulation (EU 2016/679, hereinafter "GDPR"). OfSpectrum, Inc. acts as the data controller for the personal data described in this policy. Our contact details are provided in Section 12.

In this Privacy Policy, the following definitions apply:

1.1 Any references to "OfSpectrum, Inc.", "OfSpectrum Group", "us", "we", or "our" means the Site's proprietary owners, OfSpectrum, Inc.

1.2 Service means the ofspectrum.com, OfSpectrum-branded apps, Google Slides add-on, watermarking, voice protection services, and other related offerings.

1.3 Site means a site operated by us and includes each of ofspectrum.com and any other domain that we may use from time to time.

2. Information We Collect

2.1 How do we collect non-personal information?

When you visit our Site, we collect non-personal information from you including, without limitation, which sections of the Site are most frequently visited, how often and for how long, your browser and monitor type, IP address, and any errors appear during the visit. This data is always used as aggregated, non-personal information. We may analyze this non-personal information and use it to improve our services.

The audio content you provide is exclusively used to apply watermarking services, and it will not be shared or processed for any other purpose by us.

2.2.4 When you make a purchase or attempt to make a purchase through the Site (e.g. Subscription), we collect the following information (which includes personal information) from you:

Email address

Payment information (we do not have access to your entire card number or CVC as this is handled by third party services)

2.3 Information we receive from third parties

We may receive information about you (including personal information) from third parties. If you access our Site through a third-party connection or log-in, for example, through Google account, that third party may pass certain information about your use of its service to us. This information could include, but is not limited to, the user ID associated with your account, an access token necessary to access that third party service, any information that you have permitted the third party to share with us, and any information that you have made public in connection with those third party services. If you'd like to unlink your third party account from our Site, you can adjust your settings in the third party service and we will no longer receive information collected about you in connection with that service.

2.4 Usage data and device information

Some of this information may be classified as personal information. Additionally, as you browse the Site, we may collect information about the individual web pages or products that you view, what websites or search terms refer you to the Site and information about how you interact with the Site. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser and stored on your device. 3. Use of Collected Data

3.1 Providing our products and services — Lawful basis: Contract performance (GDPR Art.6(1)(b)). We use the information you provided to provide our products and services. This includes allowing you to create a Site account and log in to your account, giving you access to our services and products, and recognising you across different services and devices. Other usages may include verifying your account, reset passwords, etc.

3.2 Communicating with you — Lawful basis: Contract performance (Art.6(1)(b)) and Legitimate interest (Art.6(1)(f)). We use the information you provided, including your contact information, to communicate with you. This includes sending you notifications about important service progress, messages you received on our Site, key updates and changes to our products and services, and advertisement information related to our products and services.

3.3 Making business transactions — Lawful basis: Contract performance (Art.6(1)(b)). We use the information you provided to support your transactions on our Site. This includes allowing you to make a payment, describing services, purchasing additional services and products, and billing you for transactions you make via our Site.

3.4 Performing data analytics — Lawful basis: Legitimate interest (GDPR Art.6(1)(f)). We use the information you provided to improve our products and services. This includes but is not limited to generating analytics about how our users browse our Site and making improvements according to analytics. Our goal is to improve your user experience, but not exploit your information.

3.5 Customizing our products and services — Lawful basis: Legitimate interest (GDPR Art.6(1)(f)). We use the information you provided to customize our products and services to your needs.

3.6 Keeping our Site secure — Lawful basis: Legitimate interest (GDPR Art.6(1)(f)). We use the information you provided to keep our Site secure. This includes recognizing fraud and potential risks, enhancing the security of our Site, identifying violations of our Privacy Policy, Terms of Use, and any other contracts or agreements you signed.

3.7 Where required by law — Lawful basis: Legal obligation (GDPR Art.6(1)(c)). We use the information you provided to ensure that nothing violates the law. You can withdraw your consent to these services at any time, but failing to consent may cause limited access to certain services.

3.9 Please note that we prohibit the sale of Google user data to third-parties.

You may refuse to provide the personal information we requested at any time, but this may limit or prohibit your access to our products and services. You may withdraw your consent for personal information use at any time by contacting us through support@ofspectrum.com.

4. Third-Party Sharing

4.1 Third-parties

Outside our authorized personnel employed by us, we only share your personal information with third parties that meet the data privacy conditions described in this Privacy Policy. These third parties help us to better use your personal information to provide our products and services. These parties include:

Cloud infrastructure providers: Amazon Web Services (AWS) for hosting our database and backend services.

Payment processors: Stripe Inc. for subscription billing and payment processing. Stripe receives only the data necessary to process your transaction (email, payment details). Stripe's privacy policy is available at https://stripe.com/privacy.

Authentication providers: Google LLC (OAuth) if you choose to sign in with your Google account. We receive only your email address and basic profile information that you have authorized Google to share.

Government third parties such as government agencies, regulatory bodies and law enforcement agencies as required, authorized or permitted by law.

4.2 Service providers

These are companies that assist us in delivering our services, such as cloud storage providers, online payment solutions providers, but only as necessary and under strict confidentiality agreements.

4.3 Legal disclosures

We may be required to disclose personal data for legal process and lawful requests by public authorities. We may need to disclose personal information if it is required by law, subpoena, and other legal processes. We may also disclose personal information if we believe the disclosure is necessary to: (a) investigate suspected or actual illegal activities; (b) assist government enforcement agencies; (c) enforce our Privacy Policy, Terms of Service, contracts, and any other agreements you signed; (d) investigate and defend ourselves against any claims, accuses, or allegations; (e) protect the security or our Site and Services; (f) protect the rights and safety of Ofspectrum Group, our users, personnel or others.

4.4 Cross-border data transfers

Our core data processing infrastructure (database and backend services) is hosted on Amazon Web Services (AWS) servers. Audio processing (watermarking, AI detection, encryption) is performed on our own servers and does not involve third parties.

When personal data is transferred to countries outside the European Union, we rely on the following legal safeguards:

5. Data Security

We implement security safeguards designed to protect your data, such as HTTPS. We regularly monitor and update our systems for possible attacks and vulnerabilities. However, we cannot guarantee the security of data. There is no guarantee that all data may not be accessed, disclosed, altered, or destroyed by breach of any of our security safeguards.

6. Your Data Rights

You have the right to access, correct, and manage your personal information. For all users, the following rights apply. For EU/EEA residents, these rights are guaranteed under the GDPR:

6.1 Right of Access (Art.15): You have the right to know what personal data we hold about you and to request a copy.

6.2 Right to Rectification (Art.16): You have the right to correct inaccurate or incomplete personal data. You can do this through your account settings or by contacting us.

6.3 Right to Erasure (Art.17, “Right to be Forgotten”): You have the right to request deletion of your personal data when it is no longer necessary, you withdraw consent (where applicable), or it has been unlawfully processed. Use the “Delete Account” feature in your account settings or email support@ofspectrum.com. We will complete deletion within 30 days.

6.4 Right to Restriction of Processing (Art.18): In certain circumstances, you have the right to request that we suspend processing of your data rather than deleting it immediately. Contact support@ofspectrum.com to make such a request.

6.5 Right to Data Portability (Art.20): You have the right to receive your personal data in a structured, commonly used, machine-readable format. Use the “Export My Data” feature in your account settings.

6.6 Right to Object (Art.21): For data processed on the basis of legitimate interest (such as analytics), you have the right to object. Contact support@ofspectrum.com.

6.7 Right to Withdraw Consent (Art.7(3)): For data processed on the basis of consent (such as marketing emails), you may withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing prior to withdrawal.

Response time: We will respond to your request within one month. If necessary, this may be extended by two additional months (we will inform you of the reason for the extension).

7. Data Retention

We retain different categories of personal data for different periods, based on the purpose of processing and applicable legal requirements:

In some cases, we may retain certain information in a depersonalized or aggregated form where it no longer identifies you.

8. Children's Policy

Our services are not intended for users under the age of 16. If your country's law requires a higher minimum age, that higher age applies. We do not knowingly collect personal data from anyone under 16. If we become aware that such data has been collected, we will suspend the account and delete the data promptly. 9. Links to Other Websites and Services

Our Site may allow access to third party content and services with your prior consent. We are not responsible for the practices employed by websites or services accessible from the Site, including the information or content contained within these websites or services. When you use a link to go from our Site to another website, our Privacy Policy and any other agreements do not apply to third-party websites or services. Your browsing and interaction on any third-party website or service that has a link or advertisement on our Site is subject to that third party’s own policies.

10. Changes to Our Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes to it, we will post the revised policy on our website and provide users the opportunity to review the changes before they become effective. If you object to any changes, you may close your account or stop using our Products and Services.

You acknowledge that your continued use of our Products and Services after we publish or send a notice about the update of this Privacy Policy means that the collection, use and sharing of your personal information is subject to the updated Privacy Policy, as of its effective date.

11. Account Closure

You may delete your account at any time through the “Delete Account” feature in your account settings, or by contacting us at support@ofspectrum.com.

Upon account closure, we permanently delete your account information, including any project, media, audio or text information uploaded by you, within 30 days, except as noted below.
